Welcome to Pixtv.

Lucky Days Co. LTD, which operates the Pixtv services (“we,” “us,” or “our”), is committed to protecting the privacy and security of your personal information. This Privacy Policy explains how we collect, use, disclose, and protect your data when you use our services, including our website at pixtv.com and related platforms (collectively, the “Services”).

By using the Services, you agree to the practices described in this Privacy Policy.

1. Scope of This Policy

This Policy applies when you use the Pixtv website, content publishing, project collaboration, and other related Services.

If a particular feature has a separate privacy notice or authorization page, that notice applies together with this Policy. If there is any inconsistency, the notice for the specific processing activity will control.

This Policy does not apply to third party websites, model services, payment services, or other external services. When you use those third party services, you should also read their privacy policies and terms of service.

2. Information We Collect

We will collect and use your personal information in accordance with the principles of lawfulness, legitimacy, minimal necessity and transparency, and for the purposes set out in this Policy. Should we use your personal information for purposes not specified in this Policy, or collect and use your personal information for other specific purposes, we will provide you with a detailed explanation of the relevant rules regarding the collection and use of such information—including but not limited to updating this Policy, re-signing documents, page notifications, pop-ups, in-app messages, emails, website announcements or other means that facilitate your access to such information) to explain in detail the rules regarding the collection, purpose, method and scope of the relevant information, and ensure that these new requirements continue to comply with the principles of lawfulness, legitimacy and necessity, avoiding any extension beyond the original scope, and only collecting and using such information after obtaining your authorisation and consent.

It is particularly important to note that even where we have obtained your authorisation to access your relevant permissions, we will only do so within the scope of your authorisation; furthermore, should you refuse to provide such authorisation, this will merely prevent you from using the relevant features, but will not affect your normal use of other features of the product and/or service.

In order to provide services to you, we will collect and use your personal information in the following ways:

(1) Account Information

When you register for or log in to Pixtv, we may collect:

  • mobile phone number and email address;
  • username, avatar, and nickname;
  • login credentials and account security information;
  • team, workspace, or organization information;
  • account creation time, login records, and account status.

(2) User Uploaded and Generated Content

To provide AI creation services, we may process:

  • uploaded images, videos, audio, and text;
  • creative instructions and prompts;
  • image nodes, video nodes, and project files on the canvas;
  • character reference images, background images, source materials, and templates;
  • AI generated images, videos, audio, and thumbnails;
  • content that you publish, share, bookmark, or comment on;
  • generation task parameters, task status, model names, and consumption records.

This content may include likenesses, voices, names, written works, trade secrets, or other personal information. Please ensure that you have the right to upload and use the relevant content.

(3) Device and Log Information

We may automatically collect:

  • IP address and approximate network location;
  • device model, operating system, and browser type;
  • network status, language, time zone, and screen information;
  • login, click, upload, generation, publishing, and download records;
  • error logs, crash information, and performance data;
  • generation task duration, failure reasons, and API call records.

(4) Transaction Information

If you purchase memberships, points, or other value added services, we may collect:

  • order number;
  • product type, amount, and payment status;
  • invoice information;
  • refund, charge, and customer support handling records.

Full bank card numbers, payment passwords, and similar information are processed by payment institutions. Pixtv generally does not store complete bank card information.

(5) Customer Support and Communications

When you contact customer support, submit feedback, file a complaint, submit a copyright claim, or make a security report, we process the name, contact information, account information, issue description, and related attachments that you provide.

3. How We Use Information

We may use relevant information to:

  1. create and manage Pixtv accounts;
  2. save and synchronize your projects, canvases, and generated content;
  3. carry out image editing, video generation, and content publishing requests;
  4. complete AI generation based on the materials, creative instructions, and parameters you submit;
  5. process memberships, points, orders, and refunds;
  6. provide project collaboration, sharing, commenting, and publishing features;
  7. measure model usage, task success rates, and service consumption;
  8. detect unlawful content, infringing content, fraud, and malicious use;
  9. handle failures, complaints, copyright claims, and security incidents;
  10. improve product performance, stability, and user experience;
  11. comply with legal obligations, enforce platform rules, and protect user safety.

Unless we obtain your separate authorization, Pixtv will not use your non public images, videos, audio, text, or generated content to train general models provided to the public.

We may use anonymized or de identified data for statistics, quality evaluation, and technical analysis.

4. AI Services and Third Party Processing

To complete generation tasks you request, Pixtv may provide necessary information to the following types of service providers:

  • cloud server and object storage providers;
  • image, video, and audio processing providers;
  • AI model and inference providers;
  • content safety and moderation providers;
  • payment, login, and identity verification providers;
  • data analytics, logging, and customer support providers.

Depending on the feature and model you select, relevant content may be sent to model providers for inference processing. We transmit information only to the extent necessary to complete the task, and we use contracts, permission management, and security measures to limit third party use.

Model service providers actually integrated may include:

  • Alibaba Cloud Model Studio;
  • OpenAI;
  • other image, video, or audio model providers selected by Pixtv.

Third party model providers may have independent data retention, processing, and security rules. We will update provider information on product pages, third party sharing lists, or related feature descriptions.

5. User Content, Copyright, and Commercial Use

This section explains how Pixtv processes user content. Specific content publishing rules, copyright responsibilities, commercial licensing, and violation handling may also be set out in the User Agreement, Content Rules, or specific campaign rules.

(1) Your Responsibility for Input Materials

You must ensure that the images, videos, audio, text, likenesses, music, fonts, trademarks, and other materials you upload to Pixtv have a lawful source and that you have the rights or authorization required to use, edit, publish, and commercially use them.If your content or input infringes the rights of others, you bear full responsibility for such infringement. This includes any input you provide to PixPix, the combination of your input with the generated content, or any claims that the use of the generated content infringes the rights of third parties.

You must not upload or use:

  • unauthorized likenesses, voices, or private information of others;
  • content that infringes another person’s copyrights, trademarks, patents, or trade secrets;
  • unauthorized film, television, animation, game, or brand materials;
  • music, voice over, fonts, or actor performances used without permission;
  • content that impersonates others through face swapping, voice imitation, or digital humans;
  • content prohibited by laws, regulations, or Pixtv rules.

(2) Rights to Use User Generated Content

Provided that you comply with laws and regulations, the Pixtv User Agreement, Content Rules, and the rules of relevant model providers, you may save, modify, publish, and commercially use images, videos, and other content generated with Pixtv.

Pixtv does not claim ownership of materials you upload and does not automatically obtain ownership of content merely because you use Pixtv to generate it.

However, whether AI generated content is a legally protected work, whether you can obtain complete copyright, whether it is exclusive, and whether it may be commercially used in a particular jurisdiction depends on:

  • the rights you hold in the input materials;
  • your actual human contribution during the creative process;
  • the terms of service of the relevant model providers;
  • the laws applicable where the content is published;
  • whether the generated content contains protected third party elements.

Pixtv does not guarantee that every AI generated item has independent copyright, is unique, or is free from third party rights risks.

(3) Content License Granted to Pixtv

You continue to own your User Content. To provide the Pixtv Services, however, you grant Pixtv a non exclusive, worldwide, royalty free, limited license to:

  • upload, store, and back up your content;
  • resize, format, and encode content;
  • submit content to the model provider you select for processing;
  • display content in your account, projects, and canvases;
  • generate, export, share, or publish content according to your instructions;
  • handle complaints, moderation, infringement claims, and security incidents.

This license is limited to operating and providing the Pixtv Services and does not mean that Pixtv obtains ownership of your content.

If you actively set content for public publishing, you also allow Pixtv to display and distribute it within the platform and to provide likes, comments, sharing, recommendation, download, or other functions related to that public content. You also authorize Pixtv to display, distribute, and use that public work to the extent necessary for platform operation, content recommendation, brand promotion, product case studies, and marketing.

Pixtv will not sell your public works as standalone materials and will not use non public content for advertising, case studies, brand promotion, or external marketing without your separate authorization.

(4) Publishing Videos on Pixtv

You may publish videos generated with Pixtv on the Pixtv platform.

Before publishing, you should confirm that:

  • the people, voices, and materials in the video have the necessary authorization;
  • the video does not infringe another person’s copyrights, likeness rights, reputation rights, or privacy rights;
  • music, fonts, dubbing, and third party materials in the video are permitted for public communication;
  • the video complies with applicable law, platform rules, and content moderation requirements.

After public publishing, other users may view, comment on, like, share, or download the relevant content, depending on Pixtv’s product settings.

You may use the features provided by the product to set content as public, visible only to you, or visible to a limited scope.

(5) Commercial Use

Subject to this Policy, the User Agreement, model provider rules, and applicable law, you may use videos generated by Pixtv for:

  • creative videos and promotional films;
  • social media publishing;
  • commercial advertising and marketing content;
  • brand promotion and ecommerce materials;
  • creative projects and client delivery;
  • other lawful commercial purposes.

Commercial use does not mean that Pixtv guarantees the content is free from third party rights issues. If a video uses unauthorized actor likenesses, film or television characters, brand marks, music, fonts, or another person’s works, the user who uploads and publishes the content is responsible.

If you participate in an official Pixtv solicitation, selection, advertising revenue share, or commercial licensing campaign, the scope, term, revenue, and method of use for the relevant content will be governed by the campaign rules or a separate agreement.

(6) AI Content Labels

Pixtv may add watermarks, metadata or other prominent markings to AI-generated images and videos in accordance with laws and regulations, the requirements of model providers or product rules.

You must not intentionally remove, obscure or alter the AI-generated markings added by the platform. Certain jurisdictions (such as China) require the disclosure of AI-generated content and the retention of corresponding markings; you must comply with the applicable laws of the publication location and the requirements of the receiving platform.

(7) Infringement Complaints and Content Handling

If we receive a valid copyright, likeness right, privacy right, or other rights complaint, Pixtv may:

  • suspend display or distribution of the relevant content;
  • restrict sharing, downloading, or publishing;
  • delete the relevant content;
  • suspend or close the relevant account;
  • retain necessary records;
  • provide information to competent authorities or rights holders to the extent permitted by law.

6. Cookies and Similar Technologies

Pixtv may use cookies, local storage, and similar technologies to:

  • maintain login status;
  • save language and interface settings;
  • save canvas and project status;
  • prevent malicious activity;
  • measure service access and performance;
  • improve product experience.

You may manage or delete cookies through your browser settings. Disabling necessary cookies may prevent login, canvas, or generation tasks from functioning properly. In the case of non-essential cookies and similar technologies for which applicable law requires consent, we will only enable them once we have obtained your consent; you may withdraw your consent at any time. Essential cookies are used for login, security and basic functionality; disabling them may result in the corresponding features becoming unavailable.

7. Information Sharing, Transfers, and Public Disclosure

Except in the following circumstances, we do not sell your personal information:

  1. to complete generation, storage, payment, or publishing requests that you actively initiate;
  2. where entrusted service providers provide cloud computing, model inference, content moderation, or technical support;
  3. according to your active sharing or public publishing instructions;
  4. as required by laws and regulations, judicial authorities, or administrative authorities;
  5. to protect the safety and lawful rights and interests of users, Pixtv, or the public;
  6. in connection with a merger, acquisition, restructuring, or asset transfer;
  7. in other circumstances with your express consent.

Where the sharing, transfer or public disclosure involves sensitive personal information, or where separate consent is required by law, we will proceed only after obtaining your separate consent. Furthermore, in circumstances where consent is not required by law—such as to fulfil statutory obligations; to safeguard national security and defence, public safety and public health; to cooperate with criminal investigations and legal proceedings; to protect your or others’ substantial legitimate rights and interests; to process information you have voluntarily disclosed; to fulfil contractual obligations; or to collect information from lawful public sources—we may share, transfer or publicly disclose the necessary personal information in accordance with the law.

If your content belongs to a team or enterprise workspace, the workspace administrator and collaborators you actively invite may access the relevant projects and content.

8. Information Retention and Deletion

We retain your personal information and User Content for the period necessary to achieve the purposes of the Services.

In general:

  • account information is retained while the account exists;
  • projects, images, videos, and generated content are retained until you delete them, delete your account, or the project is cleaned up;
  • deleted content will be deleted from online systems or made inaccessible within a reasonable period necessary to complete deletion. Copies in backup systems will be deleted, anonymized, or subject to strict access restrictions during the backup rotation cycle, unless laws and regulations, dispute handling, security audits, or other statutory retention requirements provide otherwise;
  • transaction and financial records are retained according to laws, regulations, and audit requirements;
  • operation logs and security records are retained for the period necessary for security, audit, and dispute handling.

If laws and regulations, dispute handling, security investigations, or regulatory requirements require continued retention, we may extend the retention period to the extent necessary.

9. Information Security

We take reasonable technical and organizational measures to protect personal information, including:

  • HTTPS/TLS encrypted transmission;
  • database and object storage access controls;
  • API key and secret isolation;
  • operation logs and permission audits;
  • task queue and service isolation;
  • backup and disaster recovery;
  • confidentiality management for internal personnel and service providers;
  • abnormal access and security incident monitoring.

No internet environment is absolutely secure. If a security incident may affect your rights and interests, we will take remedial measures and provide notice in accordance with applicable laws and regulations.

10. GDPR Compliance Requirements (European Users)

If you are a resident of the European Economic Area (EEA), the United Kingdom or Switzerland, you have rights under the General Data Protection Regulation (GDPR), the UK General Data Protection Regulation (UK GDPR) or the Swiss Federal Act on Data Protection (FADP), including:

  • Right of access: to request a copy of the personal data we hold about you;
  • Right to rectification: to request the correction of inaccurate data;
  • Right to erasure: to request the deletion of your personal data (‘right to be forgotten’);
  • Right to restrict processing: to request that we restrict how we use your data;
  • Right to data portability: to receive your data in a portable format;
  • Right to object: to object to specific types of processing (e.g. marketing).

(1) Withdrawal of authorisation and consent

You may grant or withdraw any authorisation or consent you have given at any time. You may do so by:

  • Disabling storage permissions or network authorisation in your device’s system settings;
  • Adjusting your preferences via our cookie or in-app settings;
  • Contacting us through email: [email protected].

When you withdraw your consent, we will no longer process the relevant personal data. However, the withdrawal of consent will not affect any processing carried out lawfully prior to the withdrawal.

(2) Legal Basis for Processing (GDPR)

Where the General Data Protection Regulation (GDPR) or other data protection laws apply, we must establish a legal basis before processing your personal data. Depending on the specific circumstances, we process personal data on the basis of one or more of the following grounds:

  • Performance of a contract. We process personal data as necessary to enter into, perform and manage the Terms of Service with you. This includes creating and managing your account, providing core services, processing payments and responding to enquiries relating to the services.
  • Consent. Where required by law or in relation to optional features, we will seek your consent—for example, to send marketing emails or access specific device data. You may withdraw your consent at any time via your settings or by contacting us. Withdrawing consent will not affect data processing that has already taken place.
  • Legal obligations. We process personal information to comply with legal and regulatory requirements, such as tax regulations, to respond to lawful requests from public authorities, or to verify identity in accordance with applicable law.
  • Legitimate interests. Where your rights and freedoms are not overridden, we will process personal information where necessary to pursue our legitimate interests. Such interests include: ensuring the security and privacy of the platform, preventing fraud and misuse, optimising service functionality, and supporting internal analysis.
  • Vital interests. In very rare circumstances, we may process personal data to protect an individual’s vital interests, such as in response to a safety emergency.
  • Legal claims. We may process relevant personal data where necessary to assert or defend legal rights, resolve disputes, or protect our own rights, those of our users, or those of the public.

(3) Transfer of data outside the European Economic Area (EEA)

We may transfer your personal data to locations outside the European Economic Area (EEA). In such cases, we will implement appropriate safeguards (such as Standard Contractual Clauses (SCCs) approved by the European Commission) to ensure that the data is adequately protected.

11. CCPA Compliance (California Residents)

If you are a resident of California, under the California Consumer Privacy Act (CCPA) and the California Privacy Rights Act (CPRA), you have the following rights within the scope of the applicable law:

  • Right to be informed: to request that we inform you of the personal information we collect, use and share about you;
  • Right to erasure: to request the erasure of personal information (subject to certain exceptions);
  • Right to rectification: to request the rectification of inaccurate personal information;
  • Right to opt out: to opt out of the ‘sale’ or ‘sharing’ of your personal information;
  • Right to restrict use: to restrict the use of sensitive personal information;
  • Right to non-discrimination: We will not discriminate against you for exercising your CCPA rights.

We do not sell your personal information for commercial gain. However, under the CCPA, certain data sharing with advertising partners may be deemed a ‘sharing’. You can opt out via our Cookie banner or by sending an email to the [email protected].

12. Privacy Laws in Other US States

We also comply with the applicable privacy laws of Virginia (VCDPA), Colorado (CPA), Connecticut (CTDPA), Utah (UCPA) and other US states with similar legislation. Residents of these states have rights similar to those under the CCPA. Please contact us to exercise these rights.

13. How You Manage Personal Information

Through Pixtv product settings or by contacting us, you may:

  • access and copy personal information;
  • correct account information;
  • delete projects, images, videos, and generated content;
  • delete your account;
  • withdraw authorizations that may be withdrawn;
  • manage public publishing status;
  • turn off marketing notifications;
  • submit privacy, copyright, or content complaints;
  • request an explanation of third party processing.

14. Protection of Minors

Pixtv does not provide registration, material upload, or other services requiring the processing of personal information to children who have not reached the minimum independent use age required by the laws applicable in their country or region. That minimum age may vary depending on your country or region.

If you are a minor under applicable law, you should use Pixtv with the consent and guidance of your guardian. If local law requires verifiable guardian consent, we will obtain that consent in accordance with law before providing the relevant Services.

If you are the guardian of a minor and discover that the minor has used Pixtv or uploaded personal information without consent, please contact us using the contact information in this Policy.

If we discover that a minor has submitted personal information without appropriate authorization, we will take measures such as deletion or restricted processing after verification.

In order to comply with applicable laws, we would like to draw your attention to the following: we do not knowingly collect personal information from children under the age of 13 (in the United States) without verifiable parental consent; where other jurisdictions impose higher standards of protection for children’s personal information, we comply with those standards.

15. Cross Border Transfers

Our servers and some of our third-party service providers may be located outside your country or region of residence. In order to provide you with our services, your personal information and user content may be transferred to other countries or regions for processing, to the extent permitted by applicable law.

Where laws such as the General Data Protection Regulation (GDPR) or the UK General Data Protection Regulation (UK GDPR) require adequate safeguards for data transfers, we will implement Standard Contractual Clauses (SCCs) or other mechanisms recognised by law and regulations, and adopt reasonable security measures. You may avoid such cross-border processing by choosing domestic services or by not using features that involve cross-border transfers.

16. Updates to This Policy

We may update this Policy based on business changes, changes to model services, changes in laws and regulations, or security requirements.

If an update has a material impact on your important rights and interests, we will explain it through a website announcement, pop up, in product notice, or another reasonable method.

The updated Policy will display a new effective date on the page. Continuing to use Pixtv after the Policy becomes effective means that you have read and understood the updated content.
